Title of bill

An act to amend the public health law and the education law, in relation to clinical education in pain management

Purpose or general idea of bill

The bill requires that all health care practitioners complete course work or training regarding pain management. It creates an advisory committee comprised of 12 members appointed by the commissioner of health and the commissioner of education to help the Department of Health develop, review and implement the appropriate educational standards.

Summary of specific provisions

Section one of the bill creates a new article in the Public Health Law to be Article 28-F titled "Pain Management" containing two sections 2900 and 2900-a. Section 2900 requires that all physicians, physician assistants, and specialist assistants complete course work for training in pain management every four years. It also creates an exemption from this requirement for those practitioners who can demonstrate that this requirement is not necessary. Section 2900-a establishes an advisory committee on pain management, which will consult with the commissioners of health and education for the development, review, and implementation of the educational standards required by the bill. Section four of the bill 6505-d amends the education law to require clinical education in pain management for licensed or certified health care practitioners under title eight of the education law. Exemptions are again obtainable, as under the Public Health Law.

Justification

Many patients suffer needlessly from debilitating pain, caused by the inadequate treatment of pain. Many health care professionals are unaware of the resources available to their patients to relieve chronic and acute pain. Some are unwilling to use those resources because they fear that they will be wrongly subjected to prosecution or professional discipline. This bill will ensure that health care practitioners stay current on pain management techniques.

Fiscal implications

To be determined.
