Title of bill

An act to authorize the West Islip union free school district to file an application with the assessor of the town of Islip for a real property tax exemption on a certain parcel

Purpose

Authorizes the West Islip union free school district to file an application for real property tax exemption on a parcel acquired by the school district from the County of Suffolk.

Summary of provisions

Section one of the bill authorizes the assessor of the town of Islip to accept from the West Islip union free school district an application for exemption from real property tax pursuant to section 408 of the real property tax law for the 2007-2008 through 2008-2009 assessment roll, for the parcel conveyed to such school district by the County of Suffolk, with such parcel being located in the town of Islip at 0 Boulevard Avenue, West Islip, otherwise known as: district 500, section 336, block 200, lot 49.

Existing law

Existing law authorizes tax exemptions be granted after the taxable status date has passed if a bill is chaptered authorizing an assessor to accept a late application.

Justification

The West Islip Union Free School District was conveyed a parcel of land from the County of Suffolk at Boulevard Avenue, West Islip on April 1, 2006, for school-related use and as such should be exempt from property taxes. The property was acquired by the County of Suffolk through a tax foreclosure in May, 2004, and real property taxes of record for the 2007-2008 through 2008-2009 tax rolls are currently due. The additional cost of paying the property taxes would be detrimental to the school district's funds and the community it serves.

Legislative history

None.

Fiscal implications

None to the state. The town would waive taxes and penalty.

Effective date

This Act shall take effect immediately.
