Title of bill

An act to amend the vehicle and traffic law, in relation to requiring periodic inspection of motor vehicle windows

Purpose

To require the inspection of vehicle windshield and window light transmittance during annual vehicle safety inspections.

Summary of provisions

Section one amends paragraph 1 of subdivision (c) of section 301 of the vehicle and traffic law by adding a new subparagraph (c) to require the inspection of vehicle windshield and window light transmittance during annual vehicle safety inspections.

Section 2 provides the effective date.

Existing law

Section 375(12-a)(b) of the Vehicle and Traffic law provides that no motor vehicle may be operated on any public highway, road or street with windows that are composed of, covered by or treated with any material that has a light transmittance of less than 70%.

Justification

Excessively tinted windows on a motor vehicle impair the driver's ability to adequately see the surrounding environment, especially at night. This not only diminishes the driver's ability to safely operate his or her vehicle, but also poses a hazard to pedestrians, bicyclists and other motorists who might not be seen by such a driver.

What's more, police enforcement issues such as drinking while driving and illegal cell phone usage cannot be enforced unless the police have an unobstructed view of the vehicle's interior. Additionally, police officer safety at traffic stops and check points demands that the officer have an unobstructed view of the vehicle driver and passengers at all times.

This bill is necessary to ensure the safety of law enforcement officers and the public by guaranteeing that tinted windows have the required light transmittance of no less than 70%.
