Title of bill
An act to amend the civil service law, in relation to certain suspension of pensions and annuities during public employment
Purpose
To prevent "double dipping by requiring that the pension of a "retired" highly-paid public employee be suspended if he or she returns to the same or substantially similar position if such pension is equal to or greater than a SG-24 salary level.
Summary of provisions
The bill amends the Civil Service Law, by adding the specification that when an employee after retirement is reappointed to the same or substantially similar position from which she/he retired then his/her allotted pension or annual annuity shall be suspended during the employment if his/her pension is equal to or more than the annual salary rate of a SG-24 level position. This provision remains in effect until the individual reaches the age of 70. The retiree would be able to earn up to the earning limitation provided for in section 212 of the Retirement & Social Security Law without suspension. This provision remains in effect until the individual reaches the age of 70.
Justification
Some highly paid appointed government employees have been retiring and then returning to work the next day at full salary and with a pension. This legislation will prevent this "double-dipping". A recent example of this practice was when a County Chief Personnel Officer retired with a pension of $108,343 only to return the next day to work at the same job with a salary of $158,374. This legislation will prevent further "gaming" of the system by highly paid appointed employees.
