Title of bill

An act to amend the civil service law, in relation to the composition of municipal civil service commissions

Purpose/summary of provisions

The purpose of the bill is to assure that the makeup of a city civil service commission accurately reflects the composition of all pertinent minority groups within the city. The bill amends section 2 of the civil service law by adding a new subdivision 13 defining the term "recognized minority group" so as to include Blacks, Hispanics, American Indian, Orientals and any other pertinent under-represented minority groups on any city civil service commission. The bill also amends section 15 of such law by expanding the membership of municipal civil services commissions to consist of five rather than three persons. A commission may not include more than three persons of the same political party.

This bill also makes the appointment of city civil service commission members subject to the approval of the city common council. The composition of the city civil service commission shall at all times consist of at least one member of the newly defined minority group and shall at all times include at least one female member apart from the minority member. Provisions for the expiration of the new commission members have also been added.

Justification

This bill seeks to expand a city civil service commission from three to five members to include members of pertinent minority groups and women. By defining "recognized minority group", this bill seeks to assure that no minority group is excluded from fair representation on a city civil service commission. Because the purpose of a commission is to oversee city civil service workers and deal with any problems they may have, a commission should accurately reflect those workers making up the work force. Moreover, because a city civil service commission is designed to represent the interest of the employees, its membership should be selected with the advice and consent of the city legislative body which represents the city's constituency.

Fiscal implications

None.

Effective date

This act shall take effect on the first of June of the first even number year following the date on which it shall have become a law.
