Title of bill
An act to amend the education law, in relation to the notification of a student's right to refuse the performance or witnessing of dissection
Purpose
To require teachers to inform students of their rights regarding the dissection of animals.
Summary of provisions
Section 1. Subdivision 4 of section 809 of the education law is amended to included the provision that teachers must inform students of their rights.
Section 2 provides for the enactment date, which is 120 days after the bill is signed into law.
Justification
Under current law students have to right to refuse to partake in the dissection of animals for moral or religious reasons, provided that the objection is substantiated by the child's parent or legal guardian. A student is allowed by law to complete an alternative project approved by their teacher, without penalty.
There is no requirement that students be informed of this right and students often assume that they have no choice in the matter. This amendment to the law requires the teacher inform students of their right to refuse participation.
