Title of bill

An act to amend the vehicle and traffic law, in relation to exempting motor vehicles owned by volunteer firefighters and used in the performance of their duties from the payment of motor vehicle registration fees and taxes

Purpose

This bill would exempt volunteer firefighters from the payment of registration fees and use tax on the motor vehicles they own and use to perform their duties.

Summary of specific provisions

This bill would amend the Vehicle and Traffic law to exempt volunteer firefighters from the payment of registration fees and use tax on the motor vehicles they own and use to perform their duties.

This bill would further amend the vehicle and traffic law, to include that distinctive plates will be given to volunteer firefighters at no expense.

Justification

The expense of a vehicle that is used in the interest of the public should not be subject to taxes and registration fees, so as to be a burden on a single person volunteering to perform public service. Volunteer firefighters, as of now, assume the full cost of registering and using the same vehicle they use to protect their community from fires. Since they are working for the benefit of the community, they should not be required to pay such taxes and fees.

Prior legislative history

2008 - S.3617 - Referred to the Standing Committee on Transportation

Fiscal implications

The Department of Motor Vehicles will lose revenue for every volunteer firefighter registering their vehicle. However, it is more important to focus on the assets the state and its localities gain as more people use this incentive to serve as volunteer firefighters and perform fire extinguishment, safety and rescue.

Effective date

This act would take effect on the first of November next succeeding the date on which it shall have become a law and shall apply to certificates of registration of motor vehicles owned by volunteer firefighters which are issued or renewed on or after its effective date.
