Title of bill
An act to amend the general business law, in relation to requiring appearance enhancement business owners to provide masks and gloves to nail specialists
Purpose or general idea of bill
This bill requires nail salon owners to provide protective masks and gloves to their employees. It also gives employees the right to wear such protection if they so choose.
Summary of specific provisions
Section one amends section 400 of the general business law by adding two new subdivisions 11 and 12. These subdivisions define "owner" and "area renter" for the purposes of the bill.
Section two amends the general business law by adding section 40S-a. This section stipulates that owners of appearance enhancement businesses are responsible for providing protective equipment to employees. It also decrees that employees shall be allowed to wear such protective equipment if they so choose.
Section three sets out the effective date.
Justification
In many nail salons, employees would like to use protective equipment such as gloves and masks while they work. However, many owners forbid or discourage their workers from doing this as it could potentially scare away customers. This can have detrimental effects on the health and safety of workers. Requiring owners to not only provide protective equipment but also mandate that they allow their workers to wear it if they so choose will help to protect nail salon workers who spend many hours a day in rooms filled with toxic fumes, chemicals and particulate matter.
