Title of bill
An act to amend chapter 154 of the laws of 1921, relating to the Port Authority of New York and New Jersey, in relation to paid time off for Port Authority police officers who become ill or injured in the performance of their duties
Purpose
To protect member of the Port authority Police Department who become injured or ill in the line of duty.
Summary of provisions
Amends the Unconsolidated Laws pertaining to the Port Authority of New York by adding a new section XXIII to providing benefits to police officers who become ill or are injured in the performance of their duties.
Existing law
Under current law, the benefits of full payment of regular salary, fringe benefits and the cost of all medical treatment and hospital care during the period of a disability of a police officers, sheriffs, deputy sheriffs, correction officers, fire fighters and other defined law enforcement personnel who become injured or ill in the performance of their duties. (See GML §207-A and §207-C.)
Port Authority Police Officers have a contractual guarantee of two years paid time or two and one-half years, if applying for disability retirement. If they have not returned to duty or retired at after this time period, they are discharged from employment.
Justification
This legislation would provide parity of benefits between municipal police officers and police officers employed by the Port Authority of New York and New Jersey with respect to benefits for injuries or illnesses sustained in the performance of duty.
Due to variations of the laws of New York, a police officer who is injured in the line-of-duty outside the City of New York receives GML §207-C protections: Police employed by the City of New York have unlimited sick leave.
Legislative history
Legislation providing a similar benefit was vetoed in 2004 and 2005 (See veto messages 282 and 28, respectively). Discussions subsequent to these vetoes ascertained that one of the main objections was the concern that offices would b able to remain on light duty with the guaranteed payment of salary after being eligible for service retirement. This legislation addresses this concern.
Fiscal implications
To be determined
Effective date
Immediately upon enactment of identical legislation by the State of New Jersey.
