Title of bill
An act in relation to providing retirement credit to Mario C. Donofrio for military service during the Korean conflict
Purpose
To allow Mario Donofrio the opportunity to purchase retirement credit for time in U.S. military service during the Korean conflict
Summary of specific provisions
Section one of the bill entitles Mario Donofrio to receive credit for his time of Korean conflict service 1, on or before December 31, 2009 he: (1) shall file a request to such effect with the head of the New York state and local employees' retirement system; and (2) shall pay to New York state and local employees' retirement system an amount equal to the product of the number of years of military service being claimed and three percent of his annual rate of compensation immediately preceding his retirement.
Section two of the bill is the effective date.
Justification
Mario Donofiro proudly served his country during the Koran conflict. He retired six months prior to the passage of a bill that would allow for veterans of the Korean conflict to receive pension credit for their time served. This legislation would resolve this unfair situation and allow Mario Donofrio to legally purchase retirement credit for his service to his country.
