Title of bill
An act to refund taxpayers in the Wilson Central School district for taxes improperly reserved by the district as determined by the state comptroller
Purpose
To refund taxpayers based on state comptroller's audit.
Summary of provisions
Section 1 states the Wilson Central School District shall be authorized and directed to refund any person the amount of any tax paid by him or her that was improperly reserved by the Wilson Central School District, as determined by the state comptroller's audit.
Section 2 states the refund shall be calculated using 2009 tax rolls and corresponding school taxable values.
Section 3 states the Wilson Central School District shall issue and mail refund checks to each taxpayer pursuant to this act in a timely manner.
Justification
The district is seeking to refund those monies in its debt service fun that represent funds deposited inconsistent with the intent of the law. The total amount is approximately $2,500,000. The district requests special legislation that allows it to:
1. Calculate the refund due to each taxpayer using the Niagara County 2009 tax rolls and corresponding school taxable values. 2. Issue checks in the amount of the refund due to each tax payer. 3. Mail checks to each recipient.
The refund would be separate from the 2009-10 tax levy which would avoid complications that a tax cap would have on the refund.
