Title of bill

An act to legalize, validate, ratify and confirm a transportation contract of the Canaseraga central school district

Purpose

This bill directs the State Education Department to reimburse the Canaseraga Central School District for a specific 2008-09 transportation contract.

Summary of provisions

Section 1 validates all of the acts taken by the Canaseraga Central School District in connection with certain transportation contracts of the 2008-09 school year. Section 2 directs the State Education Department to consider such contracts valid and proper obligations of the Canaseraga Central School District. Section 3 indicates that this act shall take effect immediately.

Justification

The Canaseraga Central School District was denied transportation aid from the New York State Education Department in the amount of $3,556. The department claimed that the reason for denial of a certain contract was due to late execution of the submission of the documentation. All other legal requirements for the contract were met by the district.

However, there are several mitigating factors that led to the untimely submission and late acceptance date. These included multiple contracts for services for the same student, caused by a change in the daily contract amount and change in aide services. The Canaseraga Central School District also experienced difficulty in procuring a timely signature from the transportation company and had to resubmit the original documents several times Upon request from NYSED.
