Title of bill

An act to amend the public authorities law, in relation to the transfer of surplus funds of the Triborough bridge and tunnel authority

Purpose

This legislation prohibits raising of tolls by the Triborough Bridge and Tunnel Authority to increase funds transferred to the Metropolitan Transportation Authority of New York City.

Summary of provisions

This bill amends subdivision 12 of §553 of the Public Authorities Law, as amended by §3 of part o of Chapter 61 of the Laws of 2000, to cap the toll rates charged for the use of any project operated by the authority for the purpose of increasing the amount of the surplus funds transferred to the MTA or the NYC Transit Authority.

Justification

Currently, it is beyond the power of any elected official to regulate the level of subsidy that the Triborough Bridge and Tunnel Authority transfers to the Metropolitan Transportation Authority and New York City Transit Authority. The cap this legislation seeks will reassert legislative control in this process without altering the present level of subsidization. Enactment of this bill will merely require the Triborough Bridge and Tunnel Authority to obtain legislative approval before increasing bridge and tunnel tolls where the purpose of the toll increase is to increase the subsidy transferred to the Metropolitan Transportation Authority and the New York City Transit Authority.
