Title of bill
An act to amend the environmental conservation law, in relation to recreational marine fishing licenses; and to repeal certain provisions of such law relating thereto
Purpose or general idea of bill
This legislation relates to recreational marine fishing licenses and repeals any fees related thereto.
Summary of specific provisions
Repeals paragraph g and h of subdivision 1 of Section 11-0702 of the Environmental Conservation Law to eliminate the fees associated with the recreational marine fishing license as established by Chapter 59 of the Laws of 2009.
Justification
Provisions that were adopted in the final 2009-10 State Budget created a recreational marine fishing license in the State of New York and imposed fees varying from $10 annually for residents and $15 annually for non-residents. Party and charter boats will be required to pay $400 for this annual license.
The Federal government has required states to institute a registration requirement to collect data. As such, this legislation leaves, the license provisions established in Chapter 59 intact in order to comply with such Federal regulatory requirement. However, there was no Federal mandate to impose a fee for the right to go fishing. New York's tourism and fishing industries need assistance during these difficult economic times rather than impediments. This legislation is necessary to repeal the fees associated with the recreational marine fishing license.
