Title of bill
An act to amend the multiple dwelling law, in relation to window guards on fire escape windows for multiple dwellings
Purpose
Provides that window guards be installed in multiple dwellings in which children 10 years of age and under reside.
Summary of provisions
This bill adds a new paragraph, (e), to subsection 1 of section 53 of the multiple dwelling law to state that:
(1) The person who manages or controls the multiple dwelling shall provide, install, and maintain, a window guard on windows in apartments and public halls in dwellings with children 10 years of age and under;
(2) The latch release system will be the only form of locking device allowed because the immediate access to the fire escape will not be impeded;
(3) Any violation of the provisions shall be guilty of a misdemeanor punishable by a fine up to $500 or imprisonment for up to six months or both.
Justification
This bill provides that window guards are to be installed in the windows of apartments or public halls of a multiple dwelling in which children 10 years of age and under reside. The window guard shall be equipped with a secure latch system that is capable of releasing in such a manner that immediate access to such fire escape is not impeded. The use of a padlock, key lock, combination lock or any other locking mechanism is strictly prohibited. Any violation of the provisions shall be guilty of a misdemeanor punishable by a fine up to $500 or imprisonment for up to six months or both, The bill protects the safety and well being of children who reside in a multiple dwelling without jeopardizing the capability of a quick and immediate access to a fire escape. The uniform usage of a latch system throughout New York State is an added safety measure providing both a secure system that can be quickly opened in an emergency and a time-tested measure that will ultimately save lives of children and adults in the case of an accident.
