BILL NUMBER:S5111
Title of bill
An act to amend the general municipal law and the civil service law, in relation to providing health services and insurance for volunteer fire- fighters and ambulance workers
Purpose or general idea of bill
This bill will relate to the provisions of law which permit health services and insurance for volunteer firefighters and ambulance compa- nies through public corporations.
Summary of provisions
Section one of this bill will amend Subdivision 7 of section 92-a of the general municipal law, as added by Chapter 331 of the Laws of 2008, to permit any public corporation to provide health insurance coverage for volunteer firefighters and volunteer ambulance workers. Section two of this bill will amend Subdivision 2 of section 163 of the civil service law, as amended by chapter 617 of the laws of 1967, to allow munici- palities to offer the New York State Health Insurance Plan (NYSHIP) to volunteer firefighters and ambulance company workers. Section 3 of this bill will provide for an immediate effective date.
Justification
Chapter 331 of the Laws of 2008 allows volunteer firefighters and ambu- lance workers to apply for municipal health insurance benefits, with the total cost of participation borne by the volunteer and his or her fami- ly. Volunteer firefighters and ambulance workers provide a valuable service to their communities, and it is appropriate that their public service be recognized. This new law will also assist in addressing recruitment shortages at some fire departments and fire districts.
Approval Memorandum Number 14 which was issued with Chapter 331 requested that a chapter amendment be enacted to address technical issues in the original legislation. This chapter amendment will clarify that the program is authorized but not mandated upon the local govern- ments located throughout New York State that are served by volunteer firefighters and ambulance company workers. In addition, this bill will make the corresponding amendment to the civil service law which allows municipalities the option to offer the New York State Health Insurance Program to their employees so that the legal authority is granted to allow these volunteers to participate in NYSHIP that is already offered to approximately 900 municipalities across New York State.
This program is modeled after a similar provision in the General Munici- pal Law that allows for volunteer school board members to purchase health benefits from the plan offered by their school district.
