BILL NUMBER:S5137A
Title of bill
An act in relation to the calculation of aid apportioned to the Shore- ham-Wading River central school district
Purpose
Relates to the calculation of aid apportioned to the Shoreham-Wading River Central School District.
Summary of provisions
Section one sets the calculation of building aid apportioned for the Shoreham-Wading River school district for any building project which aid is apportioned to pursuant to subdivision 6 of section 3602 at the greater of the following: the building aid ratio computed for use in the current year, or the building aid ration that would have been used in the 1992-93 school year.
Justification
The current law allows schools districts to utilize the highest building aid ratio that has been apportioned to the school :from 1981 to the present, as long as the State Education Department has data on file by July 1 at least three years after the building aid ratio was utilized. In order to utilize a building aid ratio, school districts must incur debt for building projects. Shoreham-Wading River never utilized the building aid ratios due to the fact that a power plant located in the school district provided enough tax base for the school to be able to complete building projects without incurring debt. The power plant has since been shut down, and the school district has lost a considerable amount of tax base.
In 2002, Shoreham-Wading River was granted a prior aid claim from the State Education Department. Included in the 2002 prior aid claim were building aid funds that should have been granted to the district in the 1992-93 school year. Due to the statutory requirement that schools have data on file within three years of when the building aid ratio was used, the district is prevented from utilizing the 1992-93 building aid ratio for projects in the future. This bill would allow the Shoreham-Wading River school district to utilize either the building aid ratio that was granted to them for the 1992-93 school year's building aid ratio, which- ever is the highest.
