Title of bill

An act to amend the executive law, in relation to including felony convictions in background checks for persons applying for membership in a fire company

Purpose

This legislation would add felony convictions as a criteria in the personal background check of a person applying for membership in a fire company.

Summary of specific provisions

This bill amends the section heading and subdivisions 1 and 3 of section 837-o of the executive law to add conviction of a felony offense as part of the personal background check of fire company applicants.

Existing law

Arson is currently the only conviction listed as part of the background check for fire company applicants.

Justification

The brave men and women who serve in fire companies receive numerous benefits as part of their membership. Therefore it is only logical to include all felony offenses as part of the background check administered by the fire companies when a person applies for membership. This bill helps fire companies make a better assessment of those applying to be members in their respective companies and disqualifies those applicants found to have a felony offense conviction in their background from membership.
