Title of bill

An act to amend the education law, in relation to terms and conditions of employment for school district superintendents

Purpose

To stop the salary disparity between the salary of BOCES District Superintendent and the Superintendent of the local constituent school districts.

Summary of provisions

Section one of the bill removes language in subparagraph 2 of paragraph a of subdivision 4 of section 1950 of the education law that sets the maximum salary for a BOCES District Superintendent. Section two of the bill sets the effective date.

Justification

Previously legislation set the maximum salary for a BOCES District Superintendent at 98% of the Commissioner of Education's 1992 salary. Since then, the formula was adjusted once in 2002 to permit salary increases of up to 5%; but this year the amount of possible increase was limited to 1 1/2%. This has resulted in a growing pay disparity between the salary of a BOCES District Superintendent and those of the superintendents of the local constituent school districts, creating a growing drain of experienced BOCES Superintendents.
