Title of bill

An act to amend the education law, in relation to authorizing charter schools to house any grade at more than one site

Purpose

This legislation would enable charter schools to house any grade at more than one site, subject to the approval of a charter authorizer

Summary of specific provisions

Section 1. Paragraph (b-l)of subdivision 1 of section 2853 of the education law, is amended and a new paragraph (b-2) is added. Section 2. This act shall take effect immediately

Justification

Authorizing a charter school to house a grade at more than one site, subject to the approval of a charter authorizer, will accomplish the following:

-Allow for more streamlined governance and management of separate sites, rather than schools, to allow for consolidation of multiple administrative functions, including unified reporting requirements, school payroll, student admission and matriculation, and other functions.

-Expand opportunities for parents to send their children to proven educational models, by allowing an existing school to add a new site by amending its charter, subject to authorizer approval, rather than a full-blown new school application process (local public hearing requirements also apply to charter revisions).

-Encourage more high schools (which are more expensive to operate) by allowing students at multiple middle school sites to matriculate to a single high school site with economics of scale to provide a full spectrum of programming even as charter schools received two-thirds of district funding levels.

It is important to note that a charter school already may operate at more than one site as long as a given grade remains at a single site. This proposal merely removes that single-site provision for the same grade level. Other key provisions included in this proposal:

-A charter school housing a single grade at more than one site would count each additional site toward the exiting cap of 200 charters issued.

-Existing charter schools are allowed to merge or consolidate to a single a single school; any union and non-union merger would result in a union school.
