Title of bill
An act to amend the workers' compensation law, in relation to certain workers in New York city vehicle repair shops
Purpose or general idea of bill
To provide workers' compensation benefits to persons who repaired, cleaned or rehabilitated vehicles or equipment owned by the city of New York that were contaminated by the September 11, 2001 terrorist attack.
Summary of provisions
Amends Subdivision 1 of section 161 of the workers' compensation law, as added by chapter 466 of the laws of 2006
Justification
Chapter 446 of the Laws of 2006 created workers' compensation benefits for members of the state and city workforce who participated in the World Trade Center rescue, recovery and cleanup operations. To be eligible for the benefit the employee had to have worked at least 40 hours from September 11, 2001 to September 12, 2002, at the World Trade Center site, the Fresh Kills Landfill, the New York City morgue or temporary morgue or manned the barges between the WTC site and Fresh Kills landfill.
Since that time it was realized that a group of affected employees were not covered in the original legislation. These are the automotive mechanics who have serviced the various contaminated vehicles and equipment that were at the various covered sites. These workers have been exposed to the same contaminants as other covered workers, but cannot be included in the benefit since they worked at the city garages to repair and rehab the vehicles instead of being at the sites outlined in the original legislation.
This bill seeks to expand this benefit to cover these affected workers.
