Title of bill

An act authorizing Stanley Chizuk to receive retirement service credit for prior service

Purpose

To allow Stanley Chizuk to receive past service credit for his time employed in the Village of Caledonia Police Department.

Summary of specific provisions

Section 1: deems Stanley Chizuk, a police officer for the Caledonia Police Department from November 1989 through 1991, and who is currently an officer with the Town of Greece Police Department, as well as a member of the New York State and Local Police and Fire System, shall be entitled to receive service credit toward his 20 year retirement plan if he files a written request to that effect with the State Comptroller within one year of the effective date of this measure.

Section 2: establishes the effective date.

Justification

Stanley Chizuk was hired by the Village of Caledonia Police Department in November 1989, at which time he elected to enroll in the 384-d plan under the New York State and Local Police and Fireman's Retirement System. However, at no fault of Mr. Chizuk, the paperwork was not properly filed with the retirement system or the police department. When this mistake was realized in 1990, Mr. Chizuk was asked to resubmit the appropriate paperwork.

In 1991, Mr. Chizuk transferred to the Town of Greece Police Department and assumed he was enrolled in the 384-d plan before transferring from the Village of Caledonia. In 1996, he was informed by Canandaigua that he was not in the 384-d plan while at Caledonia. In contacting the Village of Caledonia, Mr. Chizuk was informed that his paperwork was filed by the village in 1990, however the village was unable to reopen the 384-d plan for the police department. In 1993, the Village of Caledonia was able to obtain legislation (5.2338 of 1993) that would reopen the 384-d plan to the current Caledonia police officers, but did not reopen the plan to Mr. Chizuk.

This legislation would enable Stanley Chizuk, to receive service credit for the years 1989 to 1991, while he was a police officer with the Village of Caledonia. There would be no cost to the state since Mr. Chizuk would pay for the retirement credit himself.
