Title of bill

An act to amend the energy law, in relation to energy performance contracts in connection with public buildings and facilities

Purpose or general idea of bill

The purpose of this bill is to require energy performance contracts to also include a study of the cost and feasibility of at least one alternative renewable energy source.

Summary of specific provisions

Section One of this bill would amend section 9-102 of the energy law, as added by chapter 733 of the laws of 1985 is renumbered subdivision 5 and amended, a new subdivision 4 is added. Subdivision 4 defines the terms alternative sources of energy. Alternative sources of energy means energy generated through (1) solar, wind, photovoltaics, tidal, geothermal, and fuel cell technologies; and (ii) low impact, run-of-river hydroelectric generating equipment with capacity up to thirty megawatts with no new storage impoundment.

Subdivision 5 defines energy performance contracts. Section 9-103 of the energy law is amended by adding a new subdivision 9 to provide that all energy performance contracts shall include an energy efficiency study of at least one renewable energy source that best fits the project's goal. Such study must include the cost of installation of such system, maintenance and operation costs for up to ten years, and an analysis of the energy savings.

Justification

This legislation would require energy performance contracts to consider alternative energy means. Energy can be generated directly from the earth and its natural resources. It can also be reused if the source is inexhaustible. Not only does this save money and precious energy resources, but it is also less hazardous to the environment. Moreover, at a time in which America is fighting a war on terror in an unstable and often hostile Middle East, this bill would also seek to improve our national security by reducing our dependence on foreign energy products.
