Title of bill

An act to amend the vehicle and traffic law, in relation to allowing firefighters, bona fide veterans' organizations and community based organizations to solicit funds on roadways

Purpose

This bill would change current state law to allow the common fundraising practice of collecting funds from passing motorist by volunteer fire departments and ambulance services.

Summary of provisions

Amends Section 1157 of the vehicle and traffic law to allow volunteer fire departments and ambulance companies to solicit donations along the roadside while also allowing the town in which the roadway is located to adequately and fairly regulate these activities.

Justification

Fire departments, firefighter organizations and volunteer ambulance services often engage in fundraising drives in which the members of the organization stand along the road at intersections to collect funds from passing motorists who remain in their cars. The most common of these is the "fill the boot" drives that occur in towns and villages across Upstate New York each summer. While the organizers of these events seek and gain local government approval according to municipal laws, such fundraising activity is not permitted according to state law. This bill would change the law to allow volunteer firefighters and ambulance services to solicit funds in these boot drives while recognizing that municipalities should have the ability to regulate the hours and days of these activities as well as require the use of safety precautions that they deem necessary and appropriate.
