Title of bill
An act to amend the private housing finance law, in relation to limited-profit housing companies in a city with a population of one million or more
Summary of provisions
This bill would amend the Private Housing Finance Law by requiring municipally-aided Mitchell-Lama projects in a city with a population of one million or more to post the first and last names of all persons on each waiting list maintained by such project, in chronological order, by such project's management office, or, if there is no management office on the site of such municipally-aided project, in such project's lobby.
Reasons for support
Under the Private Housing Finance Law, limited-profit housing companies are responsible for selecting income eligible tenants/cooperators to occupy the dwelling units in their projects. Such housing companies maintain external waiting lists for all tenant/cooperator applications for apartments as well as internal waiting lists for current tenant/cooperators who want to move to a different size apartment. These waiting lists generally list such applications in chronological order, established by date of receipt or order of selection by lottery, and may be sorted by apartment size. By requiring these waiting lists to be posted, this amendment to the Private Housing Finance Law would ensure that prospective applicants could easily track their progress on such waiting lists. Concurrently, existing tenant/cooperators on the internal waiting list would also be better able to keep track of the status of their applications for internal transfers. By making the waiting list process more open, corruptive practices can more readily be thwarted. Furthermore, by limiting such postings to the first and last names of the waiting list applicants, there would not be any breach of such applicants' privacy. Given the scarcity of Mitchell-Lama housing, it is critical that the waiting list process be as open to public scrutiny as is reasonably possible.
Accordingly, the Mayor urges the earliest possible favorable consideration of this proposal by the Legislature.
