Title of bill

An act to authorize the town of Marlborough, in the county of Ulster, to dissolve the Applewood Farms drainage district

Purpose

To authorize the town of Marlborough, in the county of Ulster, to dissolve the Applewood Farms drainage district.

Summary of provisions

Section 1 states that the town of Marlborough, acting by and through its town board, is authorized to discontinue and dissolve the Applewoods Farm drainage district. The town board of the town of Marlborough may, upon its own motion and without petition, but after a public hearing, dissolve and discontinue such drainage district, provided that there be no indebtedness, outstanding and unpaid, incurred to accomplish any of the purposes of the district.

Justification

A local farming family had established a drainage district in order to develop a piece of property. In a proactive measure the Town of Marlborough set up a separate drainage district that would have been appropriate if this property was a residential development. The plans to sell and develop this property have been dissolved. The family desires to continue farming on the property. This legislation was requested by the Town of Marlborough.
