An act to create the temporary state commission on value added assessment, and providing for the repeal of such provisions upon expiration thereof

Purpose

To examine the potential of value-added assessments as a means of informing instruction, enhancing accountability and improving educational outcomes for New York's school children.

Summary of provisions

Section 1 provides for the creation of the Temporary State Commission on Value-Added Assessment and establishes its goals.

Section 2 provides for the appointment of members of the Commission.

Section 3 provides that the members and expert advisors shall receive no compensation, but shall be allowed reimbursement for actual and necessary expenses incurred in the performance of their duties.

Section 4 provides that the Commission may designate expert advisors in the development and implementation of value-added assessments.

Section 5 provides that the department of education shall provide the commission with such facilities, assistance, and data as will enable the commission to carry out its powers and duties.

Section 6 provides that the commission shall present its finding to the governor and the legislature by June 30, 2010.

Section 7 sets an immediate effective date.

Justification

A growing number of states and school districts are incorporating value-added measures into their assessment systems for students and schools. Chapter 57 of the laws of 2007 directed the Board of Regents to develop a modified accountability system based on an interim growth model subject to the approval of the US Department of Education to be implemented by the start of the 2008-09 school year. The system was to serve as platform for an enhanced accountability system that would incorporate a value-added assessment model by the 2010-2011 school year.

In the enacted 2008-09 State Budget, the Legislature further agreed to establish a legislative commission to study the merits of value-added assessments pursuant to a chapter.

Utilizing a statistical method, value-added growth models measure the academic progress of individual students and groups of students over time. This approach allows school districts to track individual student progress from year- to-year and to attribute such growth to various factors or conditions. The information can help schools to determine which programs, strategies, and interventions are effective with which groups of students.

Under a program piloted by Capital Region BOCES, fifty school districts across the state are using value-added analysis to evaluate the effectiveness of their educational programs this school year.

In a recent letter to Governors regarding the second phase of funding under the American Recovery and Reinvestment Act, (ARRA) the U.S. Department of Education (USED) indicated it will look favorably upon applications from states that include estimates of individual teacher impact on student achievement in a manner that informs instruction and includes appropriate benchmarks.
