Title of bill

An act to amend the environmental conservation law, in relation to the collection and recycling of beverage containers

Purpose

To amend various sections of Part SS of Chapter 59 of Laws of 2009 to recognize the impact of current law on those involved in the state mandated beverage redemption system.

Summary of provisions

Section 1: Amends Environmental Conservation Law section 27-1007 to make changes to current law to modify deposit initiator's, redemption center's and dealer's responsibilities in the bottle and can redemption system;

Section 2: Amends Environmental Conservation Law section 27-1012 to eliminate the "refund value account" mandates and replace it with a new reporting requirement based on the number of bottles that a deposit has been placed on such bottle to the Department of Taxation and Finance;

Section 3: Effective Date.

Existing law

Chapter 59 of the laws of 2009 expanded the New York beverage control law to increase the handling fee and retain the deposit initiators unredeemed deposits.

Justification

The recent changes to New York's beverage container law did not take into full account the real world realities that the beverage industry must face to comply with the new mandates placed upon it. This legislation makes various modifications to the new law by making it easier and more practical for the industry to comply with it while at the same time making it more affordable, thus helping to protect the significant work force the beverage industry employs. This measure will state a balance between protecting our environment while also helping to preserve the careers of those that make this system beverage delivery work in New York State.
