Title of bill
An act to amend the vehicle and traffic law, in relation to unlawful solicitation of ground transportation services at an airport
Purpose or general idea of bill
This legislation would increase the penalty for unlawful solicitation of ground transportation services at airports to a class B misdemeanor for the first offense; punishable by a fine of not less than five hundred dollars nor more than one thousand two hundred fifty dollars, or by imprisonment of not more than ninety days or both such fine and imprisonment
Summary of specific provisions
This bill would amend the penalty provision of section 1220-b of the Vehicle and Traffic Law, which prohibits the unlawful solicitation of ground transportation services at airports. The present penalty provision for this offense sets forth a graduated schedule of fines for succeeding convictions. This bill would instead make this offense punishable as a class B misdemeanor.
Justification
Section 1220-b of the Vehicle and Traffic Law makes it a crime for any driver, for a price and without authorization or prearrangement, to offer ground transportation at an airport. Nevertheless, illegal hustling continues to be a problem at New York City airports. Passengers, often unfamiliar with ground transportation options, are solicited by illegal drivers upon debarking at the terminal. Section 1220-b, though it prohibits this practice, punishes initial offenses with relatively small fines which are easily accepted as a cost of doing business. In the absence of an effective penalty, the prohibited practice flourishes.
This bill would close this enforcement loophole by making unlawful solicitation of ground transportation services at airports, beginning with the first offense, a class B misdemeanor. with an effective penalty, enforcement authorities will be able to address the problem presented by illegal and unscrupulous drivers at airports.
