Title of bill

An act to amend the administrative code of the city of New York, in relation to permitting access by property owners to dwelling units in certain circumstances

Purpose

This bill expands the availability of court orders for access to inspect premises to the Department of Housing Preservation and Development, the Fire Department and a registered owner or managing agent.

Summary of provisions

This bill would amend the administrative code of the City of New York Section 27-2123 to expand the current provisions for a court order for access to inspect pursuant to law or regulation or to correct a condition pursuant to law or regulation to apply not only to the Department of Buildings, but also to the Fire Department, the Department of Housing Preservation and Development, the Fire Department or the registered owner or managing agent.

Justification

Current law allows the Department of Buildings to apply to a civil court judge for an access order. In testimony before a recent Senate Housing Committee on unlawful installation of partitions access to inspect and correct such conditions was defined as a problem for various enforcement agencies and owners that are responsible for a safe interior environment. This bill would expand the availability of this proceeding to the Fire Department, the Department of Housing Preservation and Development and the registered owner or managing agent. This expands the availability of this procedure for a court order on access, thereby standardizing a method to obtain access to inspect premises where permitted by law or regulation. This is an efficient and time effective approach which would let not only appropriate City agencies, but allow owners inspect and correct violations such as the unlawful installation of partitions which resulted in the tragic death of firefighters battling an apartment fire in the Bronx.
