Title of bill
An act to authorize the designated beneficiary of Kelly Story to file an application for retroactive membership in the New York state and local employees' retirement system
Purpose
This bill would transfer Kelly Story back into New York state and local employees' retirement system (ERS) so that she can receive credit for her 14 years of service when her death benefit amount is calculated.
Summary of provisions
Section I: Kelly Story, who was employed from April 25, 1994 though June 2008 as a teacher's aide at the Buffalo Central School District, shall be deemed to have been in the service upon which membership is based for the purpose of qualifying for the ordinary death benefit. Kelly Story, registration number 3747064-8, shall be eligible to receive from the New York state and local employees' retirement system such benefit payable on account of her death, by filing the appropriate paperwork on or before December 31, 2009.
Section II: effective date.
Justification
Towards the end of 2008, after 14 years as a teacher's aide, Kelly story was switched from the New York state and local employees' retirement system (ERS) to the Teachers Retirement System (TRS) along with all of the teacher's assistants in the Buffalo Public Schools, in order to comply with No Child Left Behind. However, because she was in the hospital with an illness that she soon died from, she did not receive the paperwork that was required to be filled out and returned in order to have her 14 years of service in ERS transferred to TRS. This legislation would transfer her back into ERS, so that her death benefit can reflect the 14 years of service that she accumulated.
