Title of bill
An act to amend the real property law, in relation to online listing of property for sale or rent
Purpose or general idea of bill
To include the compiling of online lists of real property that is for sale or rent under the definition of a "real estate broker."
Summary of specific provisions
Section 1 amends section 440 of the real property law to include that all real estate brokers may provide online listings of property for rent or sale.
Section 2 amends subdivision 1 of section 442-k of the real property law to reserve exclusive regulatory authority over the online listings of property for rent or sale to the secretary of state.
Section 3 rewords section 446-a of the real property law to exclude a licensed real estate broker who compiles and provides online listings of property for rent or sale from the definition of "apartment information vendor".
Section 4 contains the effective date.
Justification
The internet can be an efficient and cost effective tool for renters or buyers searching for property for sale or rent. The Department of State has determined that online listing of property for sale or rent is subject to Article 12-C of the real property law which regulates apartment information vendors, who provide, for a fee, printed lists of apartments for rent. The onerous requirements of Article 12-C are incompatible with the provision of an online service. This new bill lists the compiling and listing of these properties as an ability included under the definition of "real estate broker" and specifically exempts on line services from the Article 12-C. This inclusion will decrease excessive real estate searching costs and create a more efficient, direct method for finding new apartments and homes.
