BILL NUMBER:S5748A
Title of bill
An act to amend the retirement and social security law, in relation to the definition of the term final average salary as applied to members of the New York city teachers' retirement system
Summary of provisions
This legislation amends sections 443,512 and 608 of the retirement and social security law, to include members of the New York City Teachers' Retirement System within existing provisions governing the calculation of final average salary.
Justification
This legislation is designed and intended to correct a technical omis- sion affecting the calculation of final average salary for certain members in the New York City Teachers' Retirement System. Specifically, this legislation would provide statutory clarification that final aver- age salary would constitute the three highest consecutive years of a member's compensation, as opposed to a member's total compensation in the three consecutive years prior to retirement. This definitional differentiation is critical to a member who takes a leave of absence of less than or equal to 12 months at no or partial pay in the three-year period predating such member's retirement. This legislation clarifies current statute in order to provide affected members with the same bene- fits currently afforded under administrative rule and practice.
Fiscal implications
If this proposed legislation is enacted during the current Legislative Session before June 30, 2010, there would be no increase in employer contributions to NYCTRS for Fiscal Year 2010.
Effective date
This act shall take effect immediately.
