Title of bill
An act to amend the tax law, in relation to the imposition of sales and compensating use taxes in Putnam county
Purpose or general idea of bill
This bill would extend the current authorization of Putnam County to enact an additional one percent rate of sales and compensating use tax.
Summary of specific provisions
This bill would amend Section 1210 of the Tax Law, an amended by Chapter 272 of the laws of 2007, to extend the current authorization for Putnam County to enact an additional one percent sales and compensating use tax from November 30, 2009 (its present sunset date) until November 30, 2011.
Justification
The Putnam County Executive and Board of Legislators have requested by County Resolution the authorization to continue to enact a local law to impose sales tax collection by one additional percent.
Chapter 272 of the laws of 2007 authorized the County of Putnam to impose an additional 1% above the authorized 3% sales and use tax (so as to total 8 percent - 4 percent state and 4 percent local). This current 2007 authorization is scheduled to sunset on November 30, 2009. This bill would simply extend the current authorization until November 30, 2011. This bill would NOT authorize a new sales tax, but merely continue the existing authorization, for two additional years.
Prior legislative history
This is a new bill.
Fiscal implications
According to Putnam County, the additional one percent sales tax authorized by this bill would generate $12.9 million dollars that would otherwise need to be collected by real property taxes.
Effective date
This act would take effect immediately.
