Title of bill

An act to authorize the Mount Olivet Baptist Church to file an application for a real property tax exemption

Purpose or general idea of bill

To allow a retroactive application for real property tax exemption for the Mount Olivet Baptist Church, for certain real property owned in the City of Peekskill, Westchester County.

Summary of specific provisions

Section 1 of this legislation would authorize the Assessor of the City of Peekskill to accept an application, from Mount Olivet Baptist Church, for exemption from real property taxes pursuant to Section 420-a of the Real Property Tax Law for the 2008-2009 assessment roll for the parcel owned by the Church, located in the City of Peekskill at 1432 Park Street.

If accepted, the application shall be reviewed as if it had been received on or before the taxable status date established for such rolls.

If satisfied that the Mount Olivet Baptist Church would otherwise have been entitled to said exemption by the appropriate taxable status dates, the Assessor may, upon approval of the Peekskill City Council, grant exemption from taxation based on the 2008-2009 assessment roll, and owing by such Church on the effective date of this act, and make appropriate correction of the subject rolls.

If such exemption is granted and the Church has paid any tax with respect to the subject rolls, the governing body or tax department may provide for a refund or cancel all remaining unpaid taxes, interest, related fines and penalties.

Justification

The Mount Olivet Baptist Church is seeking an exemption of taxes from the date of purchase of premises located at 1432 Park Street, Peekskill, New York.

This legislation would authorize the Assessor of the City of Peekskill, upon approval of the City Council of Peekskill, to grant the exemption from taxation beginning with the date of acquisition of the property by Mount Olivet Baptist Church and make the appropriate corrections to the applicable tax roll.

It is intended by this bill to ameliorate the hardship that will be suffered by the Mount Olivet Baptist Church, a charitable entity under §420-a of the Real Property Tax Law, if it is required to pay the property taxes due as described above.
