BILL NUMBER:S5953A
Title of bill
An act authorizing the commissioner of finance of the city of New York to accept from Our Lady of Mount Carmel Society of Rosebank an applica- tion for real property tax exemption
Purpose
This legislation will exempt Our Lady of Mount Carmel Society from real estate taxes.
Summary of provisions
Section 1. Section 420-a of the real property tax law is amended by adding a new subdivision 15 to read as follows:
Notwithstanding any provision of this chapter or any other law to the contrary, real property owned by Our Lady of Mount Carmel Society of Rosebank in the borough of Staten Island, which has been used exclusive- ly by such corporation or association for carrying out thereupon chari- table purposes since the date on which the fee title was acquired by such corporation or association, shall be exempt from taxation as provided in this section.
Justification
Our Lady of Mount Carmel Society of Rosebank has been an integral part of the Rosebank community since it was incorporated in 1903. There is a shrine to the Blessed Mother which is open to the public 24 hours a day, 7 days a week. The hall is used for American Legion meetings and commu- nity board meetings, free of charge. Our Lady of Mount Carmel Society is a 501(c)(3) and is listed on the state and national registries of historic places. They are sales tax exempt, however they pay real estate taxes. They are not considered to be a church, veterans group, school, little league, etc. They do not fit any of the current criteria for real estate tax exemption. Therefore, we would like to create an amendment for Our Lady of Mount Carmel Society that would exempt them from real estate taxes.
