Title of bill
An act to amend the vehicle and traffic law and the state finance law, in relation to a mandatory surcharge for traffic offenses and infractions in Suffolk and Nassau counties
Purpose
This bill would impose a mandatory fifty dollar surcharge on certain traffic convictions adjudicated in the Suffolk County or Nassau County Police Districts.
Summary of provisions
Section 1 of the bill adds vehicle and traffic law ("VTL") § 1909-f which would require that convictions of traffic infractions adjudicated in Nassau and Suffolk are to be levied a surcharge of fifty dollars. The surcharge will be deposited in the Long Island Expressway and Sunrise Highway Patrol Fund.
Section 2 of the bill adds VTL § 97-jjjj to establish the Long Island Expressway and Sunrise Highway Patrol Fund. The funds are to be used exclusively to offset the costs of staffing the patrol units for the Long Island Expressway and the sunrise Highway in Suffolk and Nassau.
Section 3 of the bill provides that it will be effective immediately.
Existing law
VTL § 1809 establishes various mandatory surcharges.
Prior legislative history
None.
Justification
Due to the fact that the Long Island Expressway and Sunrise Highway do not currently have a sufficient number of Suffolk County Police Department patrolling officers, this bill will help off-set the costs of properly staffing the patrol units for these state roads. Nassau and Suffolk Counties each spend approximately $12 million per year policing their sections of the Long Island Expressway and Sunrise Highway. This legislation will substantially cover the law enforcement expenses of Suffolk and Nassau counties by surcharging those who violate the law.
Fiscal implications
None to the State.
This legislation would generate approximately $6.7 million in revenue for Suffolk County and approximately $7.9 million in revenue for Nassau County.
Effective date
The act takes effect immediately upon enactment.
