Title of bill

An act to amend the local finance law, in relation to authorizing and empowering the county of Suffolk to amortize the cost of payments to employees upon separation of service from the county

Purpose

This legislation would allow Suffolk County to amortize the cost of payments to employees upon separation of service from the county.

Summary of specific provisions

Section 1 of this bill amends paragraph a of section 11.00 of local finance law by adding a new subdivision 104 that empowers Suffolk County to amortize accrued and accumulated but unused and unpaid sick leave, personal leave, holiday leave, vacation time, time allowances granted in lieu of overtime compensation and any other forms of payment for time earned by such employees and payable to such employees since 2008.

Section 2 authorizes this act shall take effect immediately.

Justification

In response to the general economic downturn which has led to reduced County revenue, Suffolk County's employees have agreed to take various steps to ease the County's financial burden. Among the steps is a voluntary separation program. Under the program, incentive payments of $1,000 per year of service are offered to participating civilian employees. This legislation would allow the County to spread the impact of the separation payments over several years. This is important because it is expected that the impact of the program will create an upfront expense, although the savings will continue for years to come.

Recent arbitration awards, due to take effect July 1, 2009, will reduce the amount of severance and/or separation payments now otherwise available to certain County Employees. It is therefore anticipated that a significantly higher number of County employees will leave County employment this year. This phenomenon will create an unusual expense and this legislation will allow the county to prepare properly for such events.
