Title of bill

An act to amend the education law, in relation to the determination of tuition assistance program awards

Purpose or general idea of bill

This bill will assist students receiving TAP awards by allowing for an adjustment to such awards to accurately reflect a change in financial status under certain circumstances,

Summary of specific provisions

Section 1 amends subdivision 1 of section 663 of the education law to allow a TAP recipient to apply for an adjustment to their award based on a change in the financial status of the person, the person's spouse or parents. Such circumstances under which an adjustment may be made shall include catastrophic illness, permanent or total physical or mental disability, death, permanent or total disability, a call to active military duty, or divorce or separation.

Section 2 is the effective date.

Justification

In some cases, a student's TAP application does not reflect the true financial needs of that student Under current law, adjustments to an award are only allowed under very limited circumstances. This bill will create and outline the mechanism for financial aid officers to re-evaluate a student's financial aid application in situations where extenuating circumstances exist including catastrophic illness, total physical or mental disability, death, a call to active military duty, divorce or separation.
