Title of bill

An act to amend the environmental conservation law, in relation to the recycling of electronic equipment

Purpose

This bill makes technical corrections to Title 26 of Article 27 of the Environmental Conservation Law and authorizes manufacturers to assess a fee for the collection of electronic waste from businesses.

Summary of provisions

The following provisions are added to Title 26 of Article 27 of the Environmental Conservation Law "Electronic Equipment Recycling and Reuse" as proposed in legislative bill numbers S.6047 and A.9049:

Paragraph 1 of §27-2603 is amended by adding a new subparagraph b to clarify the acceptance responsibilities of manufacturers.

Paragraphs 4 and 8 of §27-2605 are amended to authorize manufacturers to assess a fee for the collection of electronic waste from consumers having full time employees.

Justification

This bill makes technical corrections to Title 26 of Article 27 of the Environmental Conservation Law and will allow manufacturers to continue the current practice of including the take-back of end of term electronic equipment when contracting with businesses. The amendment seeks to allow the continuation of the contractual arrangement currently agreed to between manufacturers and businesses. It is common for manufacturers and electronic waste recyclers to offer recycling services to commercial entities. This practice has been beneficial to the capture of electronic waste and should be continued under the new statewide e-waste recycling program.
