Title of bill

An act to amend the civil service law, in relation to prohibiting elected officials from collecting retirement while still in an elected position

Purpose

To suspend the pension of an elected official who retires from their elected position and is either appointed to or re-elected to the elected position that they held and continues to receive their legislative salary.

Summary of provisions

Section 1. Section 150 of the civil service law as amended by chapter 211 of the laws of 1995, is amended to read as followed: 150. Suspension of pension and annuity during public employment.

Justification

This bill would stop elected official from collecting their pension while service in the elected position they retired from. It is not fair to the public that an elected official that has served enough time in the state as an elected official can retire collect a pension and still be re-elected and collect a salary for that position. This bill would prohibit this loophole in the pension system from continuing to happen.
