Title of bill

An act to amend the vehicle and traffic law, in relation to striking a school bus while illegally overtaking or passing such bus

Purpose

To include within the misdemeanor or reckless driving, the striking of a school bus while illegally passing or overtaking such school bus

Summary of provisions

Section one amends section 1212 of the vehicle and traffic law by adding striking of a school bus or any portion thereof while operating a vehicle in violation of section eleven hundred seventy four of this title

Justification

Recently on Staten Island, a car left the scene of an accident after it hit the "stop sign" on the side of a stopped school bus that was transporting children to school. Some of children were special needs students. This problem unfortunately has become a common occurrence and it makes it difficult for law enforcement to pursue a hit and run driver of a school bus. These incidents need to be stopped not only on Staten Island but across New York State. Making such inconsiderate and dangerous driving habits a class A misdemeanor will hopefully make drivers aware of the consequences and protect school aged children before a tragedy occurs.
