Title of bill

An act to amend the public authorities law, in relation to the suspension of certain employees of the New York city school construction authority

Purpose

This legislation would provide certain employees of the New York City School Construction Authority (SCA) an opportunity to buy back service credit for time while suspended for economy measures on or after December 1, 2002 until their return to such service prior to January 8, 2008.

Summary of provisions

Amends the Public Authorities Law § 1738 by adding a new section 2 - allowing certain employees of the school construction authority who were suspended on or after December 1, 2002, because of economy measures taken by the authority to be deemed in continuous service for purposes of determining length of service for retirement and be afforded the opportunity to, upon application to the retirement system, purchase service credit for the period of suspension.

Justification

As a result of economic measures by the NYC SCA certain employees were laid off beginning December 1, 2002. These furloughed workers were able to return to active service by January 8, 2008.

After past fiscal crises that included layoffs and subsequent re-hires, workers have been permitted to buy-back lost retirement service credit. *Chapter 927 of the Laws of 1982, permitted all uniformed New York City employees who were laid off in the 1970's to buy back service credit.

*Chapter 528 of the Laws of 2001, permitted uniformed members of the NYC Department of Sanitation who were laid-off in July of 1990 to buy-back service credit. *Chapter 686 of the Laws of 2005, permitted New York City Corrections officers to buy back service for layoffs in May of 2003. *Chapter 697 of the Laws of 2006, permitted the buy-back of service credit for Carpenters who were laid off in May of 1991. *Chapter 182 of the Laws of 2007, allowed for the buying-back of service credit for layoffs in 1991 of climbers and pruners.

This legislation seeks to provide a similar benefit to the employees of the NYC SCA who were laid-off for economic reasons. The New York City School Construction Authority employees should be permitted to purchase, as their own expense, the service credit toward their pension for the time that they were laid off from the employer for economic reasons.
