Title of bill
An act to amend the agriculture and markets law, in relation to disseminating information to persons adopting a dog or cat and imposing additional penalties for animal abuse and cruelty to animals; and to amend the social services law, in relation to reporting of animal abuse
Purpose or general idea of bill
To establish a training program for persons adopting a dog or cat and imposing additional penalties for the abuse and cruelty to animals; establish guidelines for reporting animal abuse.
Summary of specific provisions
An act to amend the agriculture and markets law by adding a new section 377-b, requiring training for dog and cat owners. Any person found guilty of intentionally, recklessly or negligently torturing or cruel treatment of an animal as stated in section 353 of the agriculture and markets law will be guilty of a class E felony. This act also amends the Social Service law in relation to reporting acts of animal cruelty.
Justification
Every year several incidences of animal cruelty occur with perpetrators receiving minimal penalties. A recent local case of animal abuse: "Maximus" a two year old mixed breed pit bull from Brentwood, New York died after being chained to a tree, doused in gasoline and set on fire. Nationally, Michael Vick, an NFL quarterback, plead guilty for his part in a dog fighting ring, where losing animals were either hung or drowned.
To ensure the humane treatment of animals across New York State this legislation ensures prospective pet owners receive training prior to adoption and increased penalties for those who perpetrate acts of abuse against animals.
