BILL NUMBER:S6247A

Title of bill

An act to amend the education law, in relation to the promulgation of rules and regulations by the commissioners of education and health regarding written protocols by each school district relating to the H1N1 virus

Purpose

This bill provides for the formation of policy and procedure for the school districts in New York State to follow with regard to the H1N1 virus and authorizes a study of the feasibility of establishing a school-based influenza vaccination pilot program

Summary of specific provisions

Section 1 adds a new section to the Education Law, 101-b, which directs the commissioners of education and health to promulgate rules and regulations regarding: written protocols by each school district relating to the H1N1 virus; information to parents and staff; and procedures in the case of possible outbreak and authorizing the study of the feasibility of establishing a school-based influenza vaccination pilot program.

Justification

About 3.25 million students and 300,000 staff attend the more than 6,750 public and private schools in New York State each day. By implementing protocols for each district to follow regarding the H1N1 virus epidemic and procedures that should be followed in case of an outbreak of that virus, more than one third of the state's population can be protected from the flu.

Collaboration between the Commissioners of Education and Health will ensure that there is uniformity in the procedures and that the interests of the communities, families, schools, and businesses are all taken into account.

These procedures should include but not be limited to developing procedure to contact parents and staff regarding the dangers of the H1N1 virus and the process of notification of confirmed cases, information regarding where and when vaccinations are being offered, steps being taken by each school district regarding the prevention of the spread of the virus; and finally plans and protocol in the event of an outbreak.

In addition by creating an immunization pilot program in schools, the State will be able to fight against the spread of influenza, keeping children, teachers and families more healthy during flu season. Such a program will also serve as an opportunity for the State to improve immunization rates.

This feasibility study will examine and determine whether the NYS Department of Health can implement these pilot programs to provide influenza immunization for some of the state's younger population.
