Title of bill

An act to amend the environmental conservation law, in relation to prohibiting deposit initiators from picking up commingled containers processed through a reverse vending machine

Summary of provisions

Section 27-1003 of the Environmental Conservation Law is amended by adding a new subdivision 14 that defines a "third party pick up agent" as an entity that picks up containers processed through reverse vending machines. Section 27-1007 of the Environmental Conservation Law is amended by adding a new subdivision 12 that prohibits deposit initiators from picking up containers commingled and processed through a reverse vending machine

Justification

The recent expansion of New York's beverage container recycling program has increased the role of third party redemption agents in the container recycling process. However, the role and duties of these entities remains unclear under the current law. This new legislation will clarify that "third party pick up agents" are entities that pick up containers processed through reverse vending machines.

In order to make redemption easier and more efficient, the business opportunities for third party redemption agents should be encouraged and expanded. Therefore this legislation will mandate that no deposit originator will be allowed to pick up and process commingled containers that are processed through the reverse vending machines located at large retailers throughout the state. Since deposit originators can only pick up the particular containers they themselves distribute, this legislation will encourage the commingling of brands which streamlines the redemption process and saves smaller retailers time, space and money.
