BILL NUMBER:S6279A
Title of bill
An act to amend the private housing finance law, in relation to prefer- ences to veterans for rentals and selection of tenants by certain hous- ing companies
Purpose
The purpose of the bill is to ensure that all veterans, not just those who served during one span of time, receive a preference for Mitchell Lama housing.
Summary of provisions
Subdivision 7 of Section 31 of the private housing finance law, as added by chapter 154 of the laws of 1969, the opening paragraph as amended by chapter 650 of the laws of 1976 and paragraph (a) as amended by chapter 179 of the laws of 2006, is amended to remove the language that limits veteran preference in admission to "Mitchell Lama" housing to those who served in the armed forces between the dates of February 28, 1961 to May 7, 1975. It is replaced with a definition used by the New York State Civil service, which encompasses any individual who has served in the armed forces during a time of war, thereby including those who served in the Gulf war and the continuing conflicts in Iraq and Afghanistan.
Existing law
Section 31 of the Private Housing Law, Subdivision 7.
Justification
It is wrong that as the United States sends brave men and women to war to fight to protect our freedom, we fail to support them when they come home. The Mitchell Lama housing program is a great way for those of moderate incomes to find appropriate housing in New York. As a small token of our appreciation for their services we should ensure that they receive a preference when applying for this housing program. Under current law only those who served during specific time periods are eligible. This bill would reform those rules to allow all veterans, as established by the Civil Service definitions for New York State, to receive their well earned preference.
