Title of bill

An act to amend the environmental conservation law, in relation to marine and coastal district livery boat recreational marine fishing license

Purpose

This bill would amend the environmental conservation law to allow livery boat rental companies to purchase a bulk salt water fishing license, which will cover all rental boats in their fleet and the passenger who rent said boats.

Summary of provisions

The environmental conservation law is amended by adding a new section 13-0336-a creating a marine and coastal district livery boat recreational marine fishing license and price of said license, as well as, defining the term "livery boat". The environmental conservation law is also amended to include a new paragraph c of subdivision 5 of section 13-0355 allowing recreational fishing passengers of "livery boats" to take fish as if they held a recreational marine fishing license.

Justification

The 2009-10 New York State Budget included the imposition of a saltwater recreational marine fishing license. Within the budgetary language, Charter and Party boats are able to purchase one bulk license for four hundred dollars that will cover all passengers on the boat. However, individual boat rental companies are expected to require that each fisher going on a rented boat purchase an individual license at the cost of ten dollars for in-state residents and fifteen dollars for out-of-state residents. Due to this provision, the "livery boat" industry would be decimated because of the added cost imposed by this license. Industry leaders have noted that this cost will effectively put them out of business as fishers would be more likely to utilize charter and party boats at a lower cost.

This legislation puts livery boat rental companies on the same competitive level as charter and party boat companies by providing them with the same ability to purchase the bulk license at the cost of four hundred dollars. As a result, the livery boat companies will include the cost of the bulk license in the rental fees allowing them to spread the cost of license fee over the course of the year.
