Title of bill
An act authorizing Paul J. Kosinski to file for retroactive membership in the New York state and local employees' retirement system with tier 2 status
Purpose
To allow Paul Kosinski to be reclassified as a Tier 2 member of the New York State and Local Employees' retirement system.
Summary of provisions
Section 1 permits Paul Kosinski membership under Tier 2 of the New York State and Local Employees' Retirement System based on his employment which began on November 20, 1974 with the City of Buffalo.
Section 2 states that all the costs associated with the enactment of this legislation shall be assumed by the State of New York.
Justification
For reasons not ascribable to his own negligence, Mr. Kosinski was not offered membership in the New York State and Local Employees' Retirement System upon his initial employment in 1974. This bill would allow Mr. Kosinski, upon written request with the State Comptroller, to be reclassified as a Tier 2 member.
Legislative history
New bill - 2009.
Fiscal implications
If this bill is enacted, it is anticipated that there will be an increase of approximately $1,400 in the annual contributions of New York State for the fiscal year ending March 31, 2011.
In addition to the annual contributions discussed above, there will be an immediate past service cost of approximately $54,000 which would be borne by New York State as a one-time payment. This estimate is based on the assumption that payment will be made on March 31, 2011.
Local fiscal implications
To be determined.
Effective date
This act shall take effect immediately.
