Title of bill
An act in relation to granting Christina Paino tier I status in the New York state teachers' retirement system
Purpose
This legislation would grant Christina Paino retroactive membership in the New York State Teachers' Retirement.
Summary of provisions
Section 1 grants Christina Paino retroactive membership in the New York State Teachers' Retirement System if she files a request to do so with the head of such system on or before December 31, 2008.
Section 2 socializes the costs associated with implementation of this legislation.
Section 3 provides that any previous contributions made by Christina Paino shall not be returned to her and to are to be used to offset any past service cost.
Section 4 is the effective date of the bill.
Justification
Christina Paino was not offered the opportunity to join the retirement system when she first began public employment with the Western Suffolk Board of Cooperative Educational Services located in Dix Hills, NY on October 5, 1968. She was employed part-time by the Town of Smithtown Recreation Department from 1969 through 1976, then again from 1980 through 1992. In September 1985, she became employed by the Patchogue-Medford School District and joined the New York State Teachers' Retirement System as a Tier IV member. Since that time, she was able to obtain prior service credit for the period of her employment with Western Suffolk BOCES and the Town of Smithtown. This legislation is necessary for Christina Paino to obtain Tier I status in the New York State Teachers' Retirement System as she would have been had she been afforded the opportunity to become a member on October 5, 1968.
